Marshall man charged as 'persistent' offender in DWI arrest

Kyle J. Naylor, 46, of Marshall, was arrested Sunday, August 29, and charged with class D felony driving while intoxicated after he was stopped by a Missouri State Highway patrol officer for allegedly driving in excess of the speed limit on Missouri Highway 240.

After posting a cash-or-surety bond of $5,000, Naylor was released pending an appearance in Associate Court Oct. 28.

Naylor is charged as a persistent offender. He pleaded guilty to driving with an excessive blood alcohol content in November 1999. After pleading guilty to driving while intoxicated in April 2008, he received a suspended sentence of 180 days and paid a $500 fine. Naylor completed a two-year term of probation on that offense April 24.

If convicted, Naylor could be sentenced to a four-year term in Missouri Department of Corrections, or a year in Saline County Justice Facility, and/or pay a fine of up to $5,000.

Charges contained in reports provided by law enforcement officials are not evidence of guilt. Evidence supporting charges must be presented before a jury, whose duty is to determine if the accused is guilty or not guilty of the charges.
