Parking lot incident captured on video; Marshall man arrested

Friday, March 19, 2010
A Marshall man is in custody at Saline County Justice Facility, charged with class D felony unlawful use of a weapon following an incident in the parking lot of a local business Wednesday afternoon, March 17.

Marshall police say Michael L. Culp, 44, followed a woman out of the business after they argued inside, beat on the the driver's side window of her pickup truck with his fists and then smashed the window with a tire iron as the woman sat inside, showering her with the broken glass.

According to the report, Culp had asked the woman to meet him at the business over some property issues. The incident in the parking lot was captured on videotape; a witness on the scene also described the incident to officers in detail.

Culp is also charged with a probation violation in an earlier case. He was sentenced to probation in April 2009 following a class A misdemeanor charge of assault in the third degree involving the same victim.

If convicted, he could be sentenced to up to four years in Missouri Department of Corrections, or up to one year in county jail, and/or up to a $5,000 fine for the Wednesday incident, and be sentenced to additional jail time or a fine or both for the probation violation.

Charges contained in reports provided by law enforcement officials are not evidence of guilt. Evidence supporting charges must be presented before a jury, whose duty is to determine if the accused is guilty or not guilty of the charges.
