Report of drugs stolen from socks leads to Christmas Eve arrest for distribution

Tuesday, December 29, 2009
An arrest warrant with a cash only bond of $5,000 was issued Friday, Dec. 25, for Gregory Wayne Kimrey, 45, of Marshall.

Kimrey, now in custody at Saline County Justice Facility, was charged with class B felony distribution of a controlled substance following a visit to Marshall's Police Department Dec. 24, to discuss Kimrey's report that pills had been stolen from him.

In that report, which followed an incident in early December, Kimrey alleges a woman he lived with stole more than 60 tablets of Alprazolam, the generic substitute for Xanax, from him while he slept. The pills were in the socks Kimrey was wearing when he went to sleep.

According to the police report, Kimrey said he had given the woman similar pills "three or four times in the past."

Kimrey told officers he is currently on probation for driving while intoxicated. The incident report indicates this offense could not be confirmed, but notes that online court records show Kimrey has a history of failure to appear and is currently out on two separate bonds from Laclede County, one for possession of a controlled substance and another for driving while intoxicated (persistent). Another outstanding warrant is also on record from Taney County for possession of marijuana and possession of paraphernalia.

Kimrey's criminal history includes convictions for felony and misdemeanor stealing, felony receiving stolen property, assault, felony and misdemeanor passing bad checks, felony possession of a controlled substance and felony driving while revoked.

Charges contained in reports provided by law enforcement officials are not evidence of guilt. Evidence supporting charges must be presented before a jury, whose duty is to determine if the accused is guilty or not guilty of the charges.

thebirdman: According to the incident report filed with the probable cause statement, Kimrey obtained the pills with a legal prescription.

I don't know which is more stupid, stashing your drugs in the socks you wear while you sleep, or going to the police station to file a report when there are outstanding warrants for your arrest?

what's crazy is he felt the need, or desire, to hide the pills in his SOCKS while he slept?

what's wrong with this picture?

thebirdmaan,

Idon't know if he was planning to sell them buthe reason he has a distribution charge is because he told the police he had given the woman pills three or four times inteh the past.... basically... he told on himself!!

So he called the cops because someone stole the illegal drugs he was planning to sell? Am I reading that right?
