Hays was arrested Thursday, Nov. 19, after the victim reported the incidents to Marshall police. A police report accompanying the probable cause statement said the victim told officers she had not reported the incidents earlier because she was worried that if she said anything, Hays would hurt her.
According to the report, Hayes told officers the victim, who is 15, made up the story because they had gotten into a fight.
Hays is considered a prior and persistent offender, and as such, is punishable by an extended term of imprisonment. His criminal history includes second-degree burglary, possession of a controlled substance, third-degree assault, resisting arrest and distribution or manufacture of a controlled substance.
If convicted of the charges against him, Hays could serve up to 15 years in Missouri Department of Corrections on each count.
A court appearance date has not been established.
Charges contained in reports provided by law enforcement officials are not evidence of guilt. Evidence supporting charges must be presented before a jury, whose duty is to determine if the accused is guilty or not guilty of the charges.

Seriously, another one. What IS going on here?????
Just to be clear on the "prior and persistent" issue. It applies here because the previous crimes were felonies, which are listed in the story. It doesn't mean, in this case, that the crimes in this particular story are themselves repeat offenses.
What is needed is truth in sentencing laws in the State of Missouri. Higher minimum sentences for serious assaults and sex crimes. What you are sentenced to, you do. Stop the probation on top of probation on top of probation. It cost the tax payers everytime these people commit new crimes, so just put them in prison and pay for them there. I still believe America needs to reinstate chaingangs, work farms and hand out the death penalty for sex crimes. What were doing isn't working, so go back to the old ways and make the prisons self sustainable and take the burden off the tax payers and put it on the inmates where it belongs. But that's just my opinion, so jump all over it!
Is considered a prior persistent offender , and they live among us probley right next door . I wish we could mark them all with a identifing mark so we could let our kids know they are dangerous people . They just keep coming out of the wood work around here .
Judge Rolf is the presiding judge in the Circuit Court in Saline County. Unless he recuses himself, or the case is moved to another jurisdiction, he will be the one to hear this case.
