Hayes is being held at Saline County Justice Facility on a $10,000 cash-only bond after Marshall police searched his residence and found just under 30 grams of marijuana, individually packaged, along with other items associated with the sale of the drug.
Marshall police officers were assisted in the search by Boomer, the K-9 "officer" who came to Marshall's police department last summer.
According to an incident report filed with the probable cause statement, Hayes said a friend had given him the marijuana.
Hayes is scheduled to appear before Judge James T. "Tut" Bellamy Wednesday, Nov. 18.
According to unofficial online court records, Hayes pleaded guilty to class C felony possession of marijuana in 2003 and is currently on probation for that offense. He also pleaded guilty to driving without a valid license in 2003 and 2004, and served 10-day jail sentences for each of those offenses.
Conviction of the charges against him could put Hayes in Missouri Department of Corrections for 5 to 15 years.
Charges contained in reports provided by law enforcement officials are not evidence of guilt. Evidence supporting charges must be presented before a jury, whose duty is to determine if the accused is guilty or not guilty of the charges.

Why do you assume I've never been the victim of a crime? How would you know? And what in the world is a "liberal response," for heaven's sake? Or do you think that anyone who disagrees with you has a liberal point of view?
What you do more of than anything is set up a straw man and knock him down. That may fly as a debate tactic in high school, but you'll need more than that in the real world, especially in the courtroom, the location where you'll be doing most of your work, as a lawyer.

God forbid that nothing criminal ever happens to you or someone you know. I would hope the judge on the case would not just slap them on the hand and throw a little probation their way. Then if they violate that probation and attack someone else, that same judge will really be upset and throw a little more probation at them. Oh and when they do it again, shucks slap them with some more probation, that will teach them!

Pretty sure I didn't say anything regarding my, possession or lack thereof, of legal skills - that's your bag. But I can read, and instead of barking at the moon about probation, I did my homework and learned something about it.

Sarcastic comments on my part are no worse than the sarcastic comments on yours. You claim legal expertise (announcing you are a recent MU law school grad), but we haven't seen any of it from you yet.
You can make any comments you like about probation, but the fact is that the trend in punishment these days is to keep offenders out of jail, not to lock them up. Treatment in the community is preferred over incarceration, especially for first-time offenders and non-violent offenses. In your capacity as a recent law school graduate, I don't think it's unreasonable that we should expect you to know that.

You say that you are an MU law school graduate. I asked if you had taken any criminal law classes, for one thing, and you didn't answer.
I suggested you should read Missouri sentencing guidelines, and I don't think that's rude, certainly it's not in the nature of ranting.

I am usually the first person to jump to another's defense when the couch-cushion English professors and spelling nazis start to attack. But even I have to tell you, reading that mess you wrote left me feeling like I just crawled from under a train...that wrecked....off a bridge...into a river....into a mile-deep canyon...and exploded just before it hit the water. I seriously think I developed a brain bleed.
Personally, I hope the investigators will learn that Hayes worked in the kitchen at the high school and be able to stick him with carrying dope with intent to distribute within 1000 feet of a public school.

The Judge will just throw some more probation on him and run the charge concurrent with all of his other past and present charges. That will teach him....Right!
