Judge Robert Liston sentenced Gabriel to 30 days jail, suspended execution of sentence, and two years unsupervised probation plus court costs.
He is scheduled to appear in court at 10:30 a.m. Wednesday, Jan. 13, 2010, for a payment review hearing.
According to unofficial online records, Gabriel has previously been convicted of eight similar offenses in Missouri and Kansas, including passing worthless a check and identity theft.
Gabriel has a pending case in Saline County for class C felony passing a bad check -- $500 or more.
His next hearing for that case is scheduled for 9 a.m. Wednesday, Oct. 28, in the Division 6 Courtroom in the Saline County Courthouse. Judge James "Tut" Bellamy will oversee this hearing.

If the check writer is on probabtion he has to
pay back to the victim the amount plus $30.00. If
he goes to jail the victim never gets their money
back. So, Maybe the Judges have the best interest
of the victims.

Seems like no one ever pays for their repeated crimes in this town. why even have a court system when they just get let go. This system and its elected officials SUCK. Do your jobs and put this guy in jail where he belongs. Glad to see our taxpayer money goes to paying judges to not punish the criminals. what a waste.What a **** joke.
Wow! This sentence is beond believe. This man didn't stop when he was convicted before, how is unsupervised probation going to stop him? I hope his victims get by with such a easy out from the situation!
