Minister's case moves to Clay County.

In a hearing held by conference call Thursday, June 25, attorneys for the state and for the defendant agreed to transfer the case against David L. Ballinger, 48, of Marshall, to Clay County.

Circuit Court Judge Larry D. Harman of Clay County was appointed to hear the case after Ballinger asked for both a change of judge and a change of venue.

Ballinger was arrested and charged Saturday, April 11, with three counts of attempted statutory sodomy in the first degree. He remains in custody at Saline County Justice Facility on a $250,000 bond, but eventually will be transferred to the Clay County jail.

Ballinger was a pastor at New Grace Baptist Church in Marshall at the time the events allegedly took place in 2008, according to a probable cause statement filed by Marshall police.

A trial-setting hearing is set for July 24.
