Marshall man charged with burglary

An arrest warrant with a $5,000 cash-only bond has been issued for Matthew S. Harris, 17, of Marshall. Harris is charged with class C felony burglary in the second degree in connection with a theft June 16 at a Marshall apartment.

An incident report filed by Marshall Police Department alleges Harris entered the victim's apartment without her permission and took two cartons of cigarettes in the early morning hours of June 16.

The report further alleges Harris was observed in the well-lit apartment, with the cigarettes, by someone who has known him for several years. Harris and two others told officers he was at home with his girlfriend during the hours in question, according to the report.

Harris pleaded guilty to class A misdemeanor possession of marijuana in January 2009 and paid a $300 fine.

He is currently charged with class C felony assault in the second degree and class D felony unlawful use of a weapon in connection with an incident near Bueker Middle School in February 2009. He was released on a $7,500 bond on Feb. 13. A jury trial in that case is scheduled for Sept. 16

Charges contained in reports provided by law enforcement officials are not evidence of guilt. Evidence supporting charges must be presented before a jury, whose duty is to determine if the accused is guilty or not guilty of the charges.

"Prosecutors had asked for prison for Abbate -- he could have been sentenced to up to five years behind bars -- but the judge said he didn't see aggravating factors to justify a prison term. The judge said Abbate had a clean record before the incident, did not seriously injure the bartender, and underwent alcohol rehab "and has not had a relapse."

"If I believed sentencing Anthony Abbate to prison would stop people from getting drunk and hitting people, I'd give him the maximum sentence," Fleming said
