TV shooter gets probation

Saturday, October 4, 2008

John Phythian, 64, of Malta Bend, pleaded guilty Monday, July 14, to unlawful use of a weapon, a class D felony, in connection with an incident May 21.

Phythian fired a gun inside his home, hitting a television set, according to a report from Saline County Sheriff's Department.

A woman at the residence told a sheriff's deputy that she was watching television shortly before 11 p.m. when Phythian told her to turn it off.

When she didn't, Phythian fired a 12-gauge shotgun, hitting the television. The woman fled the residence, reporting that she heard another shot fired as she drove away, according to the report.

Investigating officers at the scene found Phythian outside the residence. According to the report, the suspect admitted he "shot the old TV."

A search of the residence turned up the damaged television, a 12-gauge shotgun and two spent shell casings.

Phythian was sentenced to five years supervised probation by Judge Dennis A. Rolf.

Maybe his point was John was sentenced to start his probation in July and it's October. Why is this big news for a Saturday? It's rather old news that wasn't reported. Maybe the ball was dropped? I would have thought Garrett's upcoming trial would have been more relavant news. (Yes, I saw the most recent story.)

Response by Eric Crump/Editor:
When we drop a ball we don't like to leave it lying on the field.

So what was probation for? Homicide of a television? or possibly threatening the lady?

If it's for killing the TV, then perhaps "Big Brother" should stay out of it, his T.V. in his house.

If for threatening the woman, why probation? That's assualt with a deadly weapon.

1laststand: I went through my briefcase and lo and behold, found my notes on the Garrett case. Mr. Garrett will be appearing in court Monday, Oct. 6, at 9 a.m. for a trial-setting hearing.

And to those of you who rushed to my defense, I thank you! Joboda, you're right on the money with your comment. We get it from both sides, which means we must be doing something right. :)

1laststand: We are following the Garrett case, too, and when there is a resolution, we will report on it. I'm at home right now and don't have my notes, and Case.net appears to be down, but I do know that Garrett's case was transferred to Judge Rolf's court.

You can, of course, always access case.net and find information on your own, if we are not quick enough for you.

i guess i shouldn't be so harsh with kathy for that i apoligize but it seems to me that we would be better off reporting on how this 700 billion dollar bailout is going to effect each and every one of us and why gas prices are so out of hand. i would like to read about issues going on in the government and the world. Maybe someone can do a series on what people can do save money and help conserve energy.

Sometimes people really astound me. We chew out the paper for not reporting stuff, and for reporting stuff. It is all so suddenly clear.

Rude comments aside - I have wondered what became of this case and had not heard the outcome until now. Thank you for reporting it Kathy. (And on a Saturday too!)

wtf you don't have anything better to report than a person getting probation for shooting his own tv. It took you this long to figure out he got probation some reporter you are. If your going to make a big deal out of nothing why don't do some research and find out what is going on with the garrett case. At least then you might be more current. earn your money and do something.

Response by Eric Crump/Editor:
We reported on charges being brought, so we wanted to report on the resolution of the case. Quite a few people were interested in it. Late is better than never.
