According to the incident report, Graham called 911 at about 4:20 p.m., July 5, and reported drugs were being sold from a residence on East Yerby Street in Marshall.
After the initial call, the 911 operator received numerous calls from the same telephone number, but each time, the caller hung up without speaking. Deputies were able to track down the caller by using her cell phone number.
Subsequent investigation by deputies revealed the address given in the first call to be fictitious; Graham reportedly denied making the calls, but eventually admitted it, allegedly telling deputies she did it "for fun."
If convicted, she faces a penalty of from 30 days to six months incarceration and a fine of up to $500.
Graham is scheduled to be arraigned Wednesday, July 30, in Division 6 courtroom before Judge James T. "Tut" Bellamy.

Foster, you are correct. I don't know you or your friends. However, you have just told everyone on the internet that you have been arrested for a felony that was lowered to a misdemeaner. If you want to get past that and start brand new, you can't continue to brag about it, which is exactly what it sounds like. Nobody asked, you simply stated it and it probably didn't shock anyone who's been reading these posts. Internet slang? Not even close. How is "so she done something work who has not" internet slang? I do not understand most of what you're typing. This is why I simply stated that she may be better off if you're not the one defending her. Nobody knows what you're getting at except she could have done worse, you're her best friend, and you should always continue to be friends with people even if they get arrested- no exceptions. This could be why you got arrested- by making bad decisions and not surrounding yourself with good influences. I would hope that you really don't feel that way because when you're on track and taking care of your family properly, you don't want to expose your family to people who spend more time in jail than at work. I, nor does anyone else, have anything to do with you or your friend's legal problems. If you don't want people to review and comment on those legal problems, 1) don't get arrested and 2) don't post those problems on the internet. If you do, be prepared to be fair game to all. I know for a fact that you can read and understand everything I typed. troygilpin, wants the judge to sentence a woman who has not even been found guilty of a minor infraction of the law (a class B misemeanor is not a felony, troygilpin -- its not even near it) to 20 years. He wants this despite that fact that an infraction of this sort does not even carry a penalty of 1 year in prison.
Folks this is a good example of what is wrong with our Country. Its thinking like troygilpin's that has lead us into what may be one of the worst decades in American history. When we leap with out looking, we find ourselves in all kinds of messes -- such as endless wars that shouldn't be happening in the first place. Perhaps its time we take another look at our approach to mistakes we and our neighbors' make and see if we can reform behavior rather than merely seeking some kind of very strange retribution and punishment. May I also suggest before we start sentencing this young woman that we see if a judge and jury agree that she is guilty?
I feel quite certain that if troygilpin were charged with a minor crime, he would want the opportunity to defend himself in front of a jury of his peers, and I doubt troygilpin would recomend he himself recieve 20 years in prison for a similar conviction if it was he who was convicted.

Your posting appeared to be one sided suggesting that the young lady should have refused questioning by the police seemed to me that you were being an advocate for her bad behavior.
As you explained that was not your intention, you were just trying to educate and once explained I applaud your efforts.

I won't go to deep into the pitfalls of asking a loaded question or comment further than to say often times a loaded question is full of assumptions based not on fact but on supposition. In addition, loaded questions are rude and merely a way of making a baseless accusation with out having to actually make the accusation and in order to avoid careful examination of said accusation.
Now to address your loaded question, let me begin by pointing out that supporting Constitutional rights and advocating defendents' rights is not the same as advocating the breaking of the law. Quite to the contrary, advocating and supporting defendents' rights and supporting our Federal and State Constitutions is actually a form of SUPPORTING THE LAW.
My commentary was narrowly focused on this aspect of this case. Too often young people are not aware of their rights under the law and they don't really listen when the police tell them "You have the right to remain silent and ANYTHING YOU SAY can and WILL BE USED AGAINST YOU IN A COURT OF LAW." This is one of the things the police tell a suspect before they do any formal questioning of the suspect, and it is an important statement. It is clear from the begining that ANYTHING the suspect says WILL be used against them -- despite their guilt or innocence. If they say, "hi" and the DA can figure out how to use that against the suspect, the prosecutor WILL use it against the suspect. The police don't say it MIGHT be used against them, but rather that it WILL be used against them. That alone is enough reason to reply "I don't want to answer any questions." At that point the questioning must stop. That is the law, and to go any further with the questioning at that point is a violation of a whole stack of laws including the 5th Ammendment of our Federal Constitution. I think young people should be aware of that. As to the guilt or innocense of any suspect, the law requires that we view the person as INNOCENT UNTIL PROVEN GUILTY.
My approach in this case is based on that time honored, traditional American legal and moral foundation. I assume the young woman is innocent. Granted she did, according to the police, incriminate herself. However, as to whether or not any statements she made are admissible in court will be decided by the Judge and not by those of us in this forum.
Clearly, we as law abiding citizens support the enforcement of the law. That is why we give our law enforcement agencies so much of our tax dollars. We want them to have the tools they need to enforce the law and we commend them when they do so. Never-the-less, supporting defendents' rights is just as important as supporting law enforcement. We, as law abiding citizens, want lawbreakers to be properly prosecuted and punished according to the law. However, we, as law abiding citizens, cannot feasably support only some laws and not others if we expect the system to work properly. Thus, my support of the enforcement (and awareness) of defendents' rights under the law is just as much a form of supporting law enforcement as is my insistance on the enforcement of all laws.
I hope this has cleared things up for you.
i do wonder if the few of you who are defending her actions family or not would still be so willing to argue the severity of this case, if something horrible might have happened. Say another family is having a real emergency like there six yr old is choking on a lego or there grandpa just had a stroke but instead of being able to concentrate on that issue the 911 dispatcher is constantly distracted by a bored 20 yr old. So the six yr old chokes to death and grandpa is in a coma now was it serious enough for you, now does it deserve punishment? She needs to be punished so that next time she gets "bored" she can think of a more productive way to spend her time. instead of wasting the time of our law enforcement and our tax payers money. And yes for you family members and friends i have had family that committed crimes or broke the law but we in no way made excuses for there actions especially when they are old enough to know better. instead of blaming these other people of being mean perhaps you should take a good long look at the actions you are allowing from this young woman. and step up and say you were wrong you deserve what you get.

I want to ask the people that are defending her a question..a 20 year old makes prank 911 calls which is wrong. She gets in trouble and people make excuses for her behavior and action. If she gets off by blaming her friend, her parents, a television show, or any other excuse she can think of don't you think that sets a bad precedent of she got away with it once...what else can or will she try to get away with?
It may seem like I am repeating er here but its mildly disturbing to see people come up with excuses for a 20 year old young lady who it seems to be responsible and adult enough to have a child but not adult enough to realize what she is doing is wrong. What will she teach her child? What will she attempt to do next and try to get away with? How much of your tax dollars do you want to section off to have law enforcement deal with her once she becomes a regular customer?
A lot of people seem to have it in their heads that law enforcement radomly pick people out to investigate or "go after". Some people think they have a goal to get as many people through their doors or on their paperwork. I don't agree with that at all. I think it is more of the opposite. Some of these people have a goal to see how much time they can tie up in a law enforcement agency to become regular customers. I may have missed the memo but why would you want that much attention? I don't think they give out a toaster as an award for the most police attention.

As for the child, it does become our problem when a parent is making prank phone calls like she's 15. Who do you think takes care of that child after making these dumb decisions? We do as tax payers. the range of punishment for a class b misdemeanor is from one day in jail up to 6 months in jail AND/OR up to a $500 fine. there is no minimum of 30 days in jail.
If this young woman has simply told the police "I don't want to answer any questions," they wouldn't have enough evidence to convict her. As it is, she has convicted herself by talking to police.
There is alot of things she could have done that would be alot worse like,do drugs then run into a tree and kill yourself and someone else, or rob and elderly couple kill them then set the house on fire, kidnap a child rape and kill them. she thought she was doing some harmless thing that in the end had a penalty. she will get what is comming to her.this isnt the first time this stuff has happend from someone her age. As far as old and cranky is concerned, the childs care is none of your business she has family that will care for her. Everyone is judging her friends and family based on what happend. A 20 year old that makes this kind of mistake needs to have a taste of reality. My goodness it is a little absurd to me, let's see, when the cops call, hang up on them. I don't belive that there was a propblem and if there was she was asked why she did it, so why didn't she say YES there was a problem instead of making her self look incompitent? She did this to herself no one else did.

Well 20 is a young age and sometimes 20 year olds do silly things. This is a class B misdemeanor and, while it certainly is a serious matter, a class B misdemeanor is not a particularly difficult charge. Her biggest mistake was placing the calls, but her next big mistake was admitting it to the police.
Folks always remember this: You do not have to answer any questions from a police officer. Your refusal to answer questions is not probable cause to place you under arrest, nor can your refusal to answer questions be used against you in any way. In court room, a police officer is not allowed to tell a jury that you refused to answer his questions -- the right to remain silent is a Constitutional right and can never be used against you in a court of law in any form or manner. However, if you choose to answer the questions of a police officer, or detective, or any other title the investigating officer uses, and you then proceed to incriminate yourself, that can be used against you.
If this young gal had refused to answer police questions by simply stating from the start "I do not want to answer any questions" and then saying nothing more, the police would have at best a flimsy case and its unlikely she would be convicted. As it is, she convicted herself by answering police questions. She would have been better off refusing to answer any questions and then hiring an attorney to discuss the case with him/her (and only him/her) after the police had finished with her.
Folks remember this. If you cannot afford an attorney at the time of questioning and you tell the police that you refuse to answer their questions, the next thing they have to do is 1.) release you if they have no other evidence satisfying the legal definition of probable cause, 2.) provide you with an attorney. Do not let cops scare you into answering questions!!!! Tell them no! Save your statements for the court room and then only on the advice of your attorney.
this young woman is a sweet girl. i honestly believe that she probably thought there was a problem, and now might be a little embarassed by the whole situation. i am not saying that actions should go without consequences, but she is going to court, and doesn't need this.
Show a little bit of respect. Everyone makes mistakes. How would you feel if you made a mistake and i put in the newspaper for everyone to laugh at.
